Enzon


In 2003 CAT, Micromet and Enzon signed a non-exclusive cross-licence agreement under which all three parties were granted freedom to conduct research under certain areas of each other's intellectual property, as well as the right to develop a defined number of therapeutic and diagnostic antibody products. CAT obtained expanded access to Micromet's and Enzon's joint patent estate in the field of single-chain antibody (SCA) technology and both Micromet and Enzon gained rights to CAT's Phage Display technology patents.

The cross-licence built on an existing agreement between Micromet and Enzon in which both parties combined their patent estates and complementary expertise in the field of SCAs, and a licence agreement between CAT, Enzon and Creative BioMolecules in 1996. In addition to the cross-licensing of intellectual property under this agreement, Enzon and CAT agreed to withdraw their pending oppositions to each other's European patents in the area of diabodies.

Under the terms of the agreement, Micromet and Enzon obtained the right within the framework of this collaboration to use CAT's Phage Display technology to create and commercialise novel human monoclonal antibody therapeutics against a defined number of targets. In addition, Enzon and Micromet each received options to develop and commercialise antibody products outside of their alliance. CAT received options to develop and commercialise diagnostic and therapeutic SCA products and broad rights to SCA-based technologies for research, including the right to sub-licence to collaboration partners.

CAT will receive royalty payments on sales of any human monoclonal antibody therapeutics that Enzon and Micromet successfully develop using CAT's intellectual property.
